From VFW District 17 Service Officer Butch Banis

Here's the latest information on free VA health care for Marines & family members who had been stationed at Camp Lejeune.

This week, on 24 September, the Department of Veterans Affairs released final regulations for the "Honoring America's Veterans and Caring for Camp Lejeune Families Act."

The published regulations put in motion VA's ability to provide hospital care and medical services for veterans, and to reimburse eligible Camp Lejeune family members for out-of-pocket health care costs related to any of the 15 covered medical conditions listed in the law (P.L. 112-154).

ELIGIBILITY:

Veterans and family members who served on active duty or resided at Camp Lejeune for 30 days or more between Jan. 1, 1957 and Dec. 31, 1987 may be eligible for medical care for 15 health conditions:

CONDITIONS:

Esophageal cancer
Kidney cancer
Multiple myeloma
Renal toxicity
Scleroderma
Non-Hodgkin's lymphoma
Lung cancer
Bladder cancer
Leukemia
Myelodysplastic syndromes
Hepatic steatosis
Neurobehavioral effects
Breast cancer
Female infertility
Miscarriage

THE BAD NEWS:

There continues to be NO automatic Disability Compensation... Unlike service in Vietnam, just being at Camp Lejeune is NOT a "presumptive condition".

This means that Disability Claims will be handled on a case-by-case basis with the Vet having the burden-of-proof requirement, that is, to show the he/she has documentation that (1) supports of claim of being exposed to the toxic chemicals and (2) that the exposure caused the adverse health condition..

The official VA Policy is: "At this time, there is insufficient scientific and clinical evidence to establish a presumptive association between service at Camp Lejeune during the period of water contamination and the development of certain diseases."
